In recent years, the Government has showed great concern and given investment priorities to fertilizer production for the purpose of basically meeting the demand of the agricultute on fertilizer; at the same time, the fertilizer industry has also overcome the existing problems to grow rapidly. In the past, we had to import up to 60% of fertilizer demand annually, but now the production meets nearly 80% of fertilizer demand in all kinds, of which the urea is assured in supply and export oriented; meanwhile, other new fertilizer types have been developed to meet various  needs of use.

The tasks of control of fertilizer market, quality and price as well as the propaganda have been also enhanced in order to prevent and limit the fraudulence, production and trading of counterfeit and poor quality fertilizers.

Apart from the achieved results, the counterfeit and poor quality fertilizers still overwhelm in some regions, many enterprises and individuals even produce and trade in counterfeit and poor quality fertilizers for profits, having bad effect on the crops productivity and causing loss to the farmers and indignation  to true enterprises.

To resolve the said issues, the Deputy Prime Minister requests Ministry of Industry and Trade and Ministry of Agriculture and Rural Development to complete and promulgate the guiding Circular for Decree No.  202/2013/NĐ-CP on fertilizer control of the Ministries in the coming July and promptly prepare and promulgate the guiding Circular on National Fertilizer Specifications; cooperate with the local authorities nationwide in perfecting the state management organization model on fertilizers according to the regulations for effective implementation of the Decree.

The Ministry of Trade and Industry in cooperation with the Ministry of Agriculture and Rural Development reviews the regulations on sanctioning of administrative violations in the field of fertilizers stated at Decree No. 163/2013/NĐ-CP in accordance with the provisions of fertilizer production and trading regulated at Decree No. 202/2013/NĐ-CP; coordinates with the Ministries and departments to submit to the Government the additional provisions of stipulating the authority of the market management forces and agencies involved in the inspection and sanctions for administrative violations on trading in poor quality and out-of-date fertilizers.

Clearly define general agents’ responsibilities

Under the direction of the Deputy Prime Minister, the market management forces nationwide are required to strengthen the management tasks in the local; review, propose and recommend the competent authorities to continuously improve the institutions, coordination mechanism and sanctions; must consider the fight against the production and trading in counterfeit and poor quality fertilizers as their key mission.

The enterprises trading in fertilizers need to restructure their distribution system, reduce intermediary units, clearly define the responsibilities of the general agents, agents and are responsible for the management of enterprises’ fertilizer quality which are delivered to the end users.

Regarding the planning management and production schedule, the Ministries, local departments and enterprises must comply with the fertilizer industry development planning, avoid spreading and overwhelming investment; make production plan based on market demand, ensure business efficiency, avoid reducing quality and dumping, and unfair competition.

The Deputy Prime Minister asks the Chairman of cities and provinces people’s committees directly under the Central Government to guide the Departments of Industry and Trade, Agriculture and Rural Development, Public Security and the market management forces tostrengthen the inspection and strict sanction on the enterprises producing and trading in counterfeit and poor quality fertilizers,and instruct on clearly defining the responsibilities in the occurrence of production, trading and traffic of counterfeit and poor quality fertilizers in the local.
