(Source: Chinhphu.vn)– The Government has recently issued the Decree on management of fertilizers, which prescribes conditions on trading, export and import of fertilizers.
The Decree prescribes 6 conditions on fertilizer trading:
1- To have Enterprise Registration Certificates or Investment Certificates or Business Registration Certificates for fertilizer business issued by competent State agencies.
2- To have stores or business locations that ensure to maintain fertilizer quality according to law regulations on products and goods quality.
3- Storage tools and equipment must ensure fertilizer quality and environmental hygiene; To have appropriate means of transport or fertilizer transportation contracts.
4- To have own warehouses or fertilizer warehouse lease agreement satisfying conditions on preserving fertilizer quality during the business term. For retail outlets, except cases of no warehouses, they must have tools and equipment to store fertilizers.
5- To have valid documents evidencing origin of production, place of import or supply of fertilizers.
6- To fully satisfy conditions on fire and explosion prevention & fighting, environmental protection, labor safety and hygiene prescribed by the law.
Conditions on fertilizer import and export
Apart from fertilizer trading conditions, the Decree also prescribes conditions on import and export of fertilizers.
In specific, for import and export of fertilizers, organizations and individuals must fully satisfy the following conditions: Having Enterprise Registration Certificates or Investment Certificates or Business Registration Certificates for fertilizer business issued by competent agencies.
In addition, organizations and individuals producing and trading in fertilizers and those engaged in fertilizer-related activities are permitted to export fertilizers upon fully satisfying the following conditions: Implementing corresponding national technical standards in manufacturing process or applying quality management systems to ensure quality of products for export; Exported fertilizers must comply with regulations of importing countries, contracts, international treaties and agreements on mutual recognition of conformity assessment with related countries and territories.
Organizations and individuals are permitted to import fertilizers upon obtaining Certificates of standard conformity for imported fertilizers issued by designated certification agencies; and imported fertilizers must have labels according to regulations on labeling, satisfying law provisions on quality of products and goods, environmental protection
